Would the JRB accept a referral where the issue is drug use by the youth?Routine drug cases could be accepted from the police as a delinquency case or from the school as a defiance of school rules case or from a parent as a beyond control case.
To accept a drug case from the police, JRBs would probably be limited to simple possession cases because the more serious charges of possession of drugs with the intent to sell or the actual sale of drugs could be considered a felony and a serious juvenile offense requiring a referral to court in most instances.
The problem with accepting a drug related case from the school or a parent is that in most cases, other than perhaps the possession of a family member's prescription drugs, or those where the child admits the nature of the substance, without police involvement, the JRB wouldn't have evidence that the substance involved is in fact an illegal drug. In those cases, the police should be involved.
