We have a shopping mall in a nearby town and children from our town get arrested at the mall for minor offenses that should be handled by our JRB but the police where they are arrested send them directly to the juvenile court. How can we get them referred to our JRB?Representatives from your JRB and police department should meet with the mall or local police where the mall is located and execute a Memorandum of Agreement that would have the mall or local police contact your police when they arrest a child who meets the requirements for referral to your JRB. Upon receipt of such notice, your police department would determine if the child and the case are JRB eligible. If so, your police department would receive the case from the arresting police department and refer it to the JRB. At the conclusion of the JRB case, the arresting police department would be notified of the outcome. If the matter was not successfully handled by the JRB, the arresting department could issue a summons and send the matter to court. The Memorandum would spell out the details of how this would work and should be signed by the police chiefs and JRB of all member towns.
