Does a JRB have to take all class D felonies or could they refuse some?Most JRBs do not take felonies but some have made exceptions. The bottom line is that there is no law that says what cases can or cannot be taken so they are free to accept some or all of them. There has to be some consistency however in the cases that are accepted for diversion so all persons have an equal opportunity and access to the JRB process. With the state funded diversion programs however, I don't know if their funding contract restricts what cases they can take. They will have to look at their contract to answer that question.
