A 17 year old caught at an underage drinking party in possession of alcohol and marijuana. Our town has a town ordinance for possession of alcohol by a minor. How should we handle the case?A 17 year old charged with the infraction of possession of alcohol by a minor, or the violation of the town ordinance for possessing alcohol, would be an adult and would be served with an infraction ticket. As an adult, they would not be eligible for the JRB.
A 17 year old charged with possessing under 1/2 of marijuana would be a juvenile and served with a juvenile summons and, as a juvenile, eligible for the JRB.
